Terms and conditions of the FastScan rewards programme for South Africa

Eligibility

 

1.       The FASTSCAN REWARDS PROGRAM applicable in South Africa (the “Programme”) will be  governed by these Terms and Conditions. The Programme requires downloading of the  Castrol FASTSCAN mobile App (“FASTSCAN App”), which allows the qualifying person, who  elects to participate in the Programme (the “Participant”), to scan and accumulate points  which can be exchanged for Rewards (as detailed under sub-paragraph entitled “Points and  Rewards” below). The Programme currently is only valid and applicable in South Africa (“the Territory”) and is open only to customers, who meet the requirements in clause 2 and who have purchased at least the required 5L of the Eligible Products (as defined and  contemplated in clause 11) in a single transaction, in the Territory during the period  commencing on 1 September 2024 and terminating on the date on which the Programme is  terminated by Castrol in accordance with these Terms and Conditions (“the Programme Period”).

 

2.       The Programme is only open and available to Participants who are natural persons, at least  18 years old and i) are legal resident in South Africa as either (a) a South African citizen; (b) a  South African permanent resident; or (c) a professional in possession of a valid South African  work permit. Castrol reserves the right to verify the age and status of all Participants.

 

3.       The Programme is not open to any Participant who is a Government Official (Elected or  appointed government officials; Executive, legislative, or judicial officials; officials of a public  or international organization; any government employee or official at any level; any employee,  officer, or director of a government-owned company; political parties and their officials and  candidates for political office). The Programme is not open to employees, consultants,  contractors, or agents of Castrol or any of its Affiliates, their families or anyone else  professionally associated with the Programme. For the purpose of these Terms and  Conditions, an “Affiliate” of Castrol shall mean any company or legal entity that directly or  indirectly controls, or is controlled by, or is under common control with Castrol (in this regard,  “control”, and each variation of that term, means that a person possesses directly or  indirectly the power to direct, or cause the direction of, the management and policies of the  other person, whether through the ownership of voting shares, by contract or otherwise)

 

REGISTRATION AND PERSONAL DATA REGISTRATION FORM

 

4.       To register in the Programme, a Participant is required to (i) download the FASTSCAN App from  Google Play or App store; (ii) enter the Participant’s data, including the contact details which  inevitably includes, valid mobile number, and other information, in the relevant section(s)  displayed on the registration form (“Registration Form”).

 

5.       The Participant must complete all mandatory fields in the Registration Form. The registration  process is not complete until the applying Participant is redirected to the ‘Thank you’ page  confirming receipt of the request to join the Programme.

 

6.       The Participant may make changes to the personal and Participant’s information on the Fastscan App. Notwithstanding, Castrol shall not bear any liability or responsibility for the delivery or otherwise of Rewards because of inaccurate Participant’s details or for any reason  whatsoever.

 

7.       Once the Participant’s details have been entered and the clause 5 “thank you” message is  received, a confirmation message (OTP) will be sent to the Participant’s mobile phone  number. The Participant will be able to access the Programme using the OTP number and  start collecting Points (as contemplated in clause 11).

 

8.       Castrol is responsible for any personal information provided in relation to the Programme on  the FASTSCAN App. Castrol will use personal information only for the purposes of  administering the Programme and providing Rewards and other relevant information via the  FASTSCAN App in relation to the Programme. Further, as Castrol is part of the bp group,  Castrol may disclose the Participant’s personal data to other bp group entities located  around the world. Transfers of personal information within the bp group are protected by bp’s  comprehensive, flexible and global compliance framework, which implements appropriate  measures and safeguards to ensure an adequate level of data protection wherever your data  is physically kept. If the Participant does not opt in to receiving marketing communications,  the Participant’s personal information will, subject always to compliance with applicable  data protection legislation, be permanently deleted shortly upon completion of the Programme.

PROMOTER / DATA CONTROLLER

 

9.       The promoter and data controller of this offer is bp Southern Africa Proprietary Limited (reg.  no. 1924/002602/07) acting through its Castrol division (“Castrol”). Castrol may utilise  services of an agent or service provider to run the Programme for Castrol.

 

PROVIDERS

 

10.      Castrol uses 3rd party service providers, such as Wipro, Scribos and ASL (which list of service  providers may be updated by Castrol from time to time) (“List of Service Providers”), to  provide support services in respect of the Programme ranging from Customer Care, provision  of QR Codes, Rewards Management and data processing. The Participant may be contacted  from time to time by the relevant parties from the List of Service Providers.

 

POINTS AND REWARDS

 

11.      In the Programme, points are awarded to the Participants for qualifying purchases of the Eligible Products during the Programme Period (“Points”). The products included in the  Programme are fully listed at castrol.com/sa-fastscan (“the Eligible Products”), which list of  products and the Point allocation may be amended and updated by Castrol from time to time at its discretion. Points may only be used on the FASTSCAN APP and may not otherwise be  converted into or redeemed for cash.

 

12.      Castrol may offer promotions on selected products included in the Programme. Unless  otherwise determined by Castrol, the Participant(s) will be enrolled automatically in these  promotions using the data which is on the FASTSCAN App. The Points accrue in the individual  Participant’s FASTSCAN App account.

 

13.      The Participant(s), when registered in a given month, receives Points for purchases of the  Eligible Products covered by the Programme from the time of registration until the end of the  Programme Period. No pre-registration retrospective purchases of qualifying products shall  be accounted for.

 

14.      As at the start of the Programme Period, the following Eligible 5l Products and Points  allocation are listed on the website contemplated in clause 11, which list may be updated  and amended by Castrol from time to time at its discretion, as per clause 11:

15.      To activate the Points in the FASTSCAN App, the Participant must follow the double  verification process, scan the QR code found at the back of the label, and enter the unique  code found inside the cap (or follow such updated process as may be communicated by  Castrol from time to time). Points cannot and will not be activated without the QR code and  unique code.

 

16.      Each QR code and unique code is valid for scanning until the date of expiry of the Programme  Period or the date on which the Scribos 360 services are no longer actively used with the  Programme, whichever date occurs earlier. 

 

17.       All Points are valid for a period of twenty-four (24) months from the entry of the Points into  the Participant’s FASTSCAN App. After this period any unused Points will automatically expire.

 

18.      Reward Delivery time: The delivery time from order confirmation can take up to 15 days, being  on average 5-7 days. The Participant will receive email information with order confirmation  and also confirmation of delivery expedition.

 

19.      Customer Service Line (“Customer Care”): Customer Care facility is available in English. Customer Care will attempt to respond to all queries within 48 hours of lodging of the query  except for weekends where responses may be rendered 36 hours or more after lodgment of  the query. 

 

20.      Rewards: Once delivered Rewards may not be exchanged. All queries or issues in relation to  the Rewards should be directed to Customer Care and any approved returns should be in  original packaging.

 

21.      Vouchers: where the Reward is in the form of a voucher, Castrol shall not be liable for the  loss of vouchers codes on account of incorrect details provided by the participant or  otherwise.

 

22.     Vouchers: All vouchers are subject to the terms and conditions of redemption applicable  thereto, whether stated on such voucher and/or on the FASTSCAN app.

 

23.     Warranty: All Rewards, including vouchers, are subject to legal statutory warranty periods if  any.

 

OTHER TERMS

 

24.      Participants are deemed to have accepted and agreed to be bound by these Terms and  Conditions during the registration process and upon completing the Registration process  described in clauses 4 to 8.

 

25.      Participants’ personal information will be used by Castrol and its Affiliates for the purposes  of administering the Programme. In addition, Participants may choose to give their express  consent to receive subsequent Castrol direct marketing communications and, where such  consent is given, Castrol will use the relevant Participants’ personal information to send such  direct marketing and other promotional communications via email and post, as set out in  more detail in Castrol’s Privacy Statement.

 

26.      If, for any reason, the internet-based requests are not capable of running as planned,  including, but not limited to, infection by computer virus, bugs, tampering, unauthorized  intervention, fraud, technical failures, or any other causes beyond the control of Castrol  which corrupt or affect the administration, security, fairness, integrity, or proper conduct of  the Programme, Castrol reserves the right, at its discretion, to cancel, terminate, modify or  suspend the Programme.

 

27.      Castrol may withhold the Rewards if it considers in its absolute discretion that the Participant  does not meet the eligibility criteria, is in breach of these Terms and Conditions, or has acted  contrary to the requirement of good faith. Castrol further reserves the right to accept, reject,  suspend or terminate any application to register or existing FASTSCAN App already in use for  any reason including but not limited to international sanctions. Further Castrol accepts no  liability or responsibility for any technical fault or malfunction, computer hardware or  software issue satellite, network or server failure of any kind. Neither Castrol nor any Affiliate  of Castrol has any control over communications networks and shall not be responsible for  entries lost in transmission, or received late due to high online traffic levels, for technical  malfunction or otherwise.

 

28.    Points can be used to purchase vouchers from participating suppliers, as may be available  on the app / website from time to time, and that the specific terms and conditions applicable  to such vouchers will apply.

 

29.     These Terms and Conditions and any non-contractual obligations arising out of or in  connection with them, shall be governed by and construed in accordance with South African  law. Disputes arising out of or in connection with either the Programme or these Terms and  Conditions shall be subject to the exclusive jurisdiction of the South African courts.

 

30.      Nothing in these Terms and Conditions shall be construed as limiting or excluding Castrol’s  liability for fraud, death or personal injury caused by Castrol’s negligence, or any other liability  to the extent the same may not be excluded as a matter of law.

 

31.      Participation in the Programme and subsequent use of the Rewards is at the Participant’s  own risk. Users of the Programme must comply with any instructions by the parties in the List  of Service Providers, or Castrol advised third party, Castrol or its Affiliates while using the  Programme. Neither Castrol nor any of its Affiliates, directors, or employees will be liable for  any direct, indirect, special, consequential or other costs, expenses (including legal  expenses), losses or damages whatsoever of any kind arising out of or in connection with, (a)  access to or use of the website or any information contained in it; (b) the Programme, including, without limitation, any loss arising out of the participant not being eligible to enter  or able to enter due to any technical malfunction or communication failure or otherwise.

 

32.      Castrol does not accept responsibility for the acts and omissions of the parties named in the  List of Service Providers and/or third parties. If any of the provisions of the Terma and  Conditions is determined to be illegal, invalid or otherwise unenforceable, then the remaining provisions of the Terms and Conditions shall continue in full force and effect.

 

33.      All trademarks, text, images, and logos relating to Castrol, or third parties involved in this  Programme and used in relation to it, are the exclusive property of Castrol or those third  parties and participation in the Programme does not confer any rights to a Participant in or  over or grant any right to use these.

 

34.      Proof of request is not automatically proof of receipt of a request by Castrol.

 

35.      Any tax which a Participant may be required to pay under the laws of any relevant jurisdiction on any Rewards awarded pursuant to the Programme shall be the responsibility of that Participant.

 

36.      Castrol may, at its sole discretion and at any time, suspend or disqualify a Participant, reject  any application, amend the provisions of the Terms and Conditions, cancel or suspend the  Programme (either in whole or for residents of a specific country or territory) substitute the  Rewards and/or withdraw the Rewards catalogue contents. The Participant undertakes and  agrees that it shall have no claims against Castrol, or any Affiliate of Castrol and no liability  shall attach to Castrol or any Affiliate of Castrol as a result of an event of force majeure and  that the exercise of any discretion by Castrol shall not result in any compensation being  payable or paid to the Participant or other person.

 

37.      In these Terms and Conditions, the expression “event of force majeure” shall mean any  event affecting the performance of the offer or any provision of these Terms and Conditions arising from or attributable to acts, events, omissions or accidents which are beyond the  reasonable control of Castrol and/or its Affiliates, including without limitation, any  pandemics or similar events, abnormally inclement weather, flood, lightning, storm,  explosion, earthquake, subsidence, structural damage, epidemic or other natural physical  disaster, failure or shortage of power supplies, war, military operations, riot, crowd disorder,  strike, lockouts or other industrial action, civil commotion, by reason of any legislation,  regulation, ruling or omissions (including failure to grant any necessary permissions) of any  relevant government, court or any competent national or international authority.

 

38.      Castrol reserves the right to amend and/or supplement the Terms and Conditions and the Points structure. Any amendments shall be notified in advance and made available via e-mail  and/or in the FASTSCAN App notifications.
